A carreira política do Ministro dos Negócios Estrangeiros está quase chegar ao fim. Ele foi eleito para a presidência do seu partido recentemente para substituir Mário Carrascalão depois de Lúcia Lobato ter declarado que ela não estava disponível para assumir o cargo.

Entretanto, a unidade dentro do partido PSD esteve sempre em causa. Por exemplo, quando Zacarias da Costa foi atacado pelo primeiro-ministro (PM) depois do desacordo com a sombra do PM, Ágio Pereira, na questão dos Embaixadores, naquela altura o seu partido não se emparelhou com ele.

Quando o Mário Carrascalão resignou-se do cargo de vice-primeiro-ministro, nem o presidente daquele partido, Zacarias da Costa, ou os outros membros do partido que estão no governo como o Joe Gonçalves, com a exceção da Lúcia Lobato, nenhum deles abriu a boca. A Lúcia Lobato assegurou ao público de que o PSD iria assegurar a coligação. Ela falou com muito mais autoridade do que o próprio presidente do partido.

Agora chegou a vez de o Zacarias ir sentar-se no banco dos réus. Os outros membros do seu partido, mais uma vez recorreram ao silêncio. Ao sentar-se no banco dos réus, ele deve resignar-se da presidência do seu partido. Mas para a maldita sorte deste partido quem iria suceder o Zacarias seria a Lúcia Lobato. E a carreira dela também está ameaçada visto que o marido também está envolvido em casos de corrupção!

COMPENSAÇÃO AOS "VETERANOS" ADIA REPARAÇÃO ÀS VÍTIMAS DA VIOLÊNCIA ENTRE 1974 E 1999

Díli, 29 set (Lusa) - A presidente da comissão parlamentar de Justiça, a deputada Fernanda Borges, insurgiu-se hoje contra o adiamento da discussão na especialidade da lei relativa à compensação das vítimas de crimes contra os direitos humanos realizados entre 1974 e 1999, em Timor-Leste.

O adiamento foi decidido pela mesa do Parlamento, a requerimento de um conjunto de deputados de vários partidos, quer da maioria, quer da oposição, preocupados com o facto dos veteranos da luta pela independência ainda não terem sido compensados, apesar de a lei o prever, e não haver disponibilidade financeira.

"O Parlamento tem o dever ético e moral de defender os direitos de todo o povo. Nós temos vítimas vulneráveis em todo o país que estão à espera de um pouco de apoio do Estado para poderem sobreviver e ultrapassar o passado", referiu Fernanda Borges.

"Não é porque os veteranos estão a ter problemas que se devem travar os direitos das vítimas. Já passaram 10 anos, estas vítimas vão morrendo ou vivem em situações agravadas e muito difíceis e o Estado tem o dever constitucional de as apoiar", protestou Fernanda Borges.

A proposta de lei, que dá seguimento às recomendações da Comissão de Acolhimento, Verdade e Reconciliação (CAVR), sobre a compensação às vítimas de guerra, entre 1974 e 1999, partiu da Comissão Parlamentar de Assuntos Constitucionais, Justiça, Administração Pública, Poder Local (comissão A), liderada por aquela deputada, após auscultar representantes das vítimas dos 13 distritos.

Comentando a decisão da mesa de retirar da agenda a apreciação na especialidade, Fernanda Borges, que é também presidente do Partido de Unidade Nacional (PUN), salientou que "há familiares que ainda andam à procura de pessoas desaparecidas, e é preciso um quadro legal para trabalhar nessa área mais eficazmente e de uma forma institucional".

"Esta lei é para fazer isso também. Suspender a sua apreciação porque os veteranos ainda não receberam os seus pagamentos todos não é razão suficiente. As duas coisas podem andar ao mesmo tempo e não são incompatíveis, cabendo ao Estado cuidar dos pormenores na implementação", disse.

Fernanda Borges criticou ainda "deputados que estão a representar todo o povo e optam só por proteger o direito dos veteranos", lembrando que esses, pelo menos, já possuem um quadro legal que lhes garante as compensações.

A suspensão da discussão na especialidade das propostas relativas ao Programa Nacional de Reparações e à criação do Instituto da Memória foi requerida pelos deputados de várias bancadas que participaram na resistência. Estes alegam "o impacto que a aprovação dos diplomas terá no Orçamento Geral do Estado, bem como as dificuldades práticas na sua implementação, por não estarem ainda concluídos os pagamentos aos Combatentes da Libertação Nacional, previstos na lei".

East Timor has been standing up to the Australian oil company Woodside Petroleum over development of gas and oil fields in the Timor Sea. But the stakes are high for the country’s viability.

“This is going to be seen internationally as a marker of East Timor’s capacity to engage with international investment,” says Damien Kingsbury, a professor at Deakin University’s School of International and Political Studies.

“And if they get this right then people will have confidence in the possibility of doing business in East Timor. If they get it wrong that confidence will disappear,” Dr Kingsbury says.

Australia and East Timor have agreed to split evenly the profits from the Greater Sunrise field, which lies in the Timor Sea and contains resources worth tens of billions of dollars.

But the issue of where to pipe and process gas from the field has strained relations between the neighbours.

Woodside wants to process the gas via a floating platform – the first of its kind – onto ships, while East Timor insists gas must be piped to its shores to provide local jobs and infrastructure.

But piping gas across the Timor Trough on the ocean floor would be both difficult and expensive, and seismic activity in the area would significantly increase insurance costs, Dr Kingsbury says.

‘Not in piggy bank’

“The capital for the project has to be raised by Woodside. They don’t just have it sitting in the piggy bank. And investors in the project would insist that Woodside go for the most viable option,” he says.

Australian Prime Minister Julia Gillard angered the East Timorese government when she said the plant’s location should be made “in the best interest of [Woodside] shareholders”.

East Timor Prime Minister Xanana Gusmao labelled the remarks “very disappointing” and threatened to abandon the deal with Woodside in favour of Malaysia’s Petronas energy company.

Charles Scheiner, researcher at local East Timor NGO La’o Hamutuk, says while Woodside’s position is unsurprising, Gillard should consider the wider implications of hers.

“The Australian national interest in having a successful, stable neighbour may not be the same as Woodside’s, who only want to maximize shareholder profits,” he says.

These differing perspectives underline the dispute, says Auckland University associate professor Stephen Hoadley, who wrote a chapter on East Timor in the Political Handbook of the World.

Moral claim

“East Timor are saying, ‘We’re poor, we have a moral claim on as many resources as we can get. Australia is already rich, they don’t really need it – we do.”

He says Australia, in comparison, takes a very legalistic standpoint, and is careful to maintain investor confidence.

Dr Kingsbury says Woodside’s initial handling of the dispute was high-handed and alienated East Timor’s politicians.

However, he says the East Timorese government’s reaction has – fairly or not – concerned potential investors in the country.

“I know from discussions with companies that have looked at investing in East Timor that the protests over this issue in fact reinforce the perception of sovereign risk. So I think in this regard East Timor has been its own worst enemy,” he says.

Worst fallout

Dr Kingsbury, in an article for The Age newspaper, said comments from Gusmao criticising Australia reflected the worst fallout between the countries since 2005.

However, he says the relationship between the neighbours remains fundamentally strong.

Jose Teixeira, an MP for the opposition Fretilin Party, says anti-Australian sentiment is not on the rise, nor does it exist at a substantial level in East Timor.

“I think there have been statements made by politicians who have wanted to whip things up in that regard. And I think the media has reported from a very parochial and nationalist position here,” he says.

“But I think the Timorese population should be given due credit in that they can see through that.”

Fretilin were in power in 2006 when a deal was struck with Australia allowing the joint-development of the Greater Sunrise field, known as Certain Maritime Arrangements in the Timor Sea (CMATS).

Development options

Teixeira headed the negotiations, and says while the treaty states development options are to be based on principles of commerciality, Woodside must also seek approval from the Sunrise Commission – a regulatory authority comprised of East Timor and Australia.

“So when Gillard said, ‘The company will decide in the best interests of shareholders’, yes, that’s true. But it’s equally true that it’s got to go through the process that’s approved in the treaty, including obtaining the authorisation of the regulatory authority – which involves both countries,” he says.

Australia and East Timor dispute their boundary in the Timor Sea.

East Timor argue for a boundary at the half-way point between the countries, while Australia want to maintain a border approved in 1972 with Indonesia based on the continental shelf principle.

CMATS suspended boundary negotiations for 50 years, and split the profits from Greater Sunrise equally between Australia and East Timor.

Teixeira and others accepted this, because under previous agreements East Timor would have received less than 20 percent of Greater Sunrise revenue.

Step backwards

But Scheiner says agreements including CMATS were a step backwards.

“We feel that all of Sunrise belongs to Timor-Leste under international legal principles, but that the agreements signed during the last eight years constrain Timor-Leste’s rights,” he says.

Scheiner says La’o Hamutuk is concerned about how East Timor would benefit from an onshore processing plant.

He says there is a risk that the plant could be an enclave predominantly staffed by foreigners, at odds with the local environment and culture.

La’o Hamutuk published a report in 2008 which argued East Timor’s infrastructure and law-making were insufficiently developed to maximise the benefits from Greater Sunrise.

It stated that necessary laws and institutions to protect human rights, land, environment and local economies did not exist, meaning East Timor could suffer the same “resource curse” as other nations dependent on oil income.

Scheiner says these issues are not well understood by people in East Timor, partly because of media coverage of the Greater Sunrise dispute.

“Local media sees it like a football game or a war, and rarely covers the facts – just the polemics. They’re full of misinformation, so readers here rarely have a good understanding of the substantive issues.

“And international media, with a few exceptions, make little effort to understand Timor-Leste’s rights or societal dynamics. All they see is dollars and the companies’ perspective,” he says.

China’s role

Developments such as the construction of a US$8 million Chinese-funded military headquarters have coincided with the Greater Sunrise dispute, but Dr Kingsbury rejects the notion the two are linked.

“China’s role is increasing, but it’s got nothing to do with the dispute. It’s simply to do with China’s general strategic positioning,” he says.

Dr Jian Yang from Auckland University lectures on China’s foreign relations, and says the country is growing its influence in other Pacific countries like Fiji and Tonga.

However, he says China is not in a position to challenge US-Australian dominance in the region because of “image problems” and its relatively superficial involvement with countries in the region.

Dr Kingsbury believes Woodside and the East Timorese government “are moving back together”.

“I think they’re going to resume a discussion, or at least take steps towards resuming a discussion, about how they might progress negotiations,” he says.

“I would like to think that both parties will find a way forward. It’s certainly in the interests of East Timor to have this matter sorted.”

MP Jose Texeira from Fretilin said the main role of the Ministry of Tourism, Commerce and Industry was to manage tourism aspect in the country.

“I know that the role of the Ministry of Tourism, Commerce and Industry is to promote tourism aspect in the country and should not act like tourist.

As I have information that the ship is bought by the Ministry of Tourism with total amount US$80.000 and it is not cheap,” MP Texeira said.

Meanwhile, MP Rui Menezes from the Democratic Party (PD) said that the Government did not include money to purchase ship in the general state budget for 2010.

At the same time Director for Luta Hamutuk Mericio Akara said that if this would become true then it showed that Minister of Tourism would really engage in abuse of power.

”We challenge to bring this allegation case to the court, because it seems that your allegation is not true.

EAST TIMOR AND WOODSIDE REMAIN AT ODDS OVER SUNRISE

Woodside Petroleum has denied reports it is willing to consider processing gas from the Greater Sunrise field in East Timor.

In an email to Radio Australia, Woodside spokeswoman Laura Hammer said the floating LNG remained the preferred development concept for Sunrise.

She confirmed the company discussed the land option in meetings with officials in order to explain why it wasn't viable.

But East Timor Sunrise Commissioner Fransisco da Costa Monteiro says Woodside has backed away from its position that an offshore floating platform is the best option.

He says he believes there has been a commitment by Woodside to consider all options equally.

"Woodside has retracted from its position to now submitting for our appreciation and review the three concepts," he said.

"We are talking about concepts at the moment, so there are three concepts on the table."

Mr Monteiro says the East Timor's preferred option is that the project be built in the country.

"As far as Timor Leste is concerned, which we present several times, is the position and the policy remains that...the development of the LNG should on the shores of Timor Leste," he said.

East Timorese officals have been in talks with Australian government officials and Woodside in Dili over the past two days.

The negotiations are a bid to break the impasse over East Timor's insistence that it hosts the gas processing plant.

Mr Monteiro says further talks are required.

Earlier, hundreds of protesters shouted anti-Australia slogans in East Timor before the talks.

Four hundred student protesters in the capital, Dili, shouted "Australia is a thief" and "Down with Australia" as Australian officials arrived for talks on the development of the Greater Sunrise project.

East Timor has strongly opposed the Greater Sunrise consortium's proposal to process the gas on a floating platform in the Timor Sea separating the two countries, instead of on East Timorese soil.

As suspeitas de enriquecimento ilícito, que recaem sobre dois ministros do Governo de Timor-Leste, em nada afectam o país, diz o Presidente da República. “Eu não diria crise política. São incidentes políticos normais, sobretudo, em governos formados por coligações muito alargadas. Não há qualquer impacto no nosso país. Em relação ao levantamento da imunidade do vice-primeiro-ministro, José Luís Guterres, e do ministro dos Negócios Estrangeiros, Zacarias da Costa é o processo normal”, disse.

José Ramos Horta acredita até que o caso vai ser resolvido sem afectar o próprio Executivo. “Acredito que o tribunal quando julgar o caso vai concluir que não existe qualquer enriquecimento ilícito. Todo este processo me cheira a politização”.

O Presidente timorense admite que haja casos de corrupção no seu país, mas que devem agora ser investigados por quem de direito e isso não compete ao Presidente da República, ao chefe do Governo ou a qualquer ministro.

“Apelei [à PGR, ao Provedor de Justiça e ao Comissário contra a corrupção] para que se debrucem a investigar casos de corrupção onde estão em jogos dezenas de milhões de dólares - que é o caso da importação e distribuição de arroz, importação e revenda do combustível do Estado, infra-estruturas, obras públicas e aprovisionamento - e pedi para que tenham um relatório feito até ao final do ano, o mais tardar”, refere o chefe de Estado.

Ramos Horta acredita, por outro lado, que nenhum destes casos justifica a demissão do Governo e a convocação de eleições antecipadas. Timor precisa de estabilidade para pôr em marcha as reformas que iniciou.

Presidente timorense procura investimento nacional

De visita a Portugal, o Chefe de Estado timorense vem à procura de investimento nacional para o seu país. Ramos Horta reconhece que o principal parceiro de Timor-Leste ao longo dos últimos 10 anos tem pouco peso na economia do país, uma situação que pode mudar muito em breve. “Vamos receber em Timor-Leste uma grande delegação de empresários portugueses em Outubro. Eu tenho defendido publicamente que numa altura em que Timor-Leste está a investir mais do seu fundo de petróleo e está a procurar parceiros para diversificar a aplicação do fundo de petróleo que haja um maior diálogo entre o Governo português e entidades públicas ou privadas portuguesas”.

Recentemente já foram feitos contactos com uma empresa portuguesa no sector da construção e também com a EDP. As novas tecnologias poderão ser outro nicho de mercado. Está em perspectiva o fornecimento de computadores, embora as crianças timorenses tenham de esperar por uma visita para terem em mãos os prometidos “Magalhães”.

“Já tivemos conversas com o primeiro-ministro José Sócrates, mas ainda não foi concretizado. Estamos à espera que o primeiro-ministro português possa visitar Timor-Leste para assinarmos múltiplos acordos de cooperação económica, financeira, comercial entre Portugal e Timor-Leste”, acrescenta Ramos Horta.

O Presidente timorense fala com orgulho dos progressos registados pelo seu país onde o crescimento económico atingiu os 12%, a pobreza baixou 9% e o desemprego caiu para os 11%, mas lembra também que nenhuma destas percentagens deve ser dada como adquirida. Ramos Horta diz que o seu país precisa de 10 anos de crescimento sustentado e isso só se consegue com grande estabilidade governativa. Nisso o Executivo de Xanana Gusmão pode contar com o seu total apoio, diz.

Lisboa, 29 set (Lusa) -- O Presidente de Timor-Leste manifestou-se hoje surpreendido pela constituição de dois membros do Governo como arguidos num caso de enriquecimento ilícito e de abuso de poder, perpetrado por um vice-primeiro ministro e pelo chefe da diplomacia daquele país.

Em declarações à Lusa, José Ramos-Horta disse conhecer o processo instruído pela Procuradoria Geral da República e questiona as conclusões de um caso que classificou como "humanitário" e um "episódio quase natural na vida de um país".

Em causa está a nomeação de uma funcionária para a Missão de Timor-Leste junto das Nações Unidas, em Nova Iorque, durante o anterior executivo timorense, liderado por Ramos-Horta e que foi revogada pelo arguido Zacarias da Costa, atual chefe da diplomacia do país, três meses após a sua nomeação, em agosto de 2008.

Deputy PM Guterres was believed to engage in crime as he decided to transfer US$30 thousand of salary to his spouse who was working at the Timorese Embassy to New York, where as Minister da Costa was believed to engage in crime as he knew that Deputy PM Guterres had transfer the money to his spouse, but he did not take necessary action to stop it including he was alleged to engage in abuse of power in 2007.

Director of Luta Hamutuk, Mericio Akara said the power outage continue taking place in the capital of Dili due to lack of control from the Government starting from the former Fretilin up to the AMP Government.

“Actually lack of control of the Government is starting from the Fretilin Government where they use old generator to supply power to the people emergently and the Government should find another new generator to replace the old one,” Akara said.

Akara added that Manitoba Company which was managing the EDTL had not managed the electricity well and this was happening due to lack of control from the Government.

Chief of the National Unity Party (PUN) bench in the Parliament Fernanda Borges has called on the Inspectorate General to hold a profound investigation on the decentralization projects development (PDD) as there was an indication of corruption.

”I am calling on the Inspectorate General to investigate profoundly the decentralization projects development because I have information from enterpriser union from Manatuto and Aileu that there is maladministration in the tenderization process,” MP Borges said.

MP Borges added she believed that maladministration appeared in the tenderization process would affect badly on the projects implementation.

PM GUSMAO TO NOMINATE DEPUTY FOR FOREIGN AFFAIRS MINISTER

MP Pedro da Costa from the National Congress for the Timorese Reconstruction (CNRT) has confirmed that Prime Minister Xanana Gusmao would nominate deputy for the Foreign Affairs Minister shortly.

“Prime Minister Xanana Gusmao would nominate deputy for the Foreign Affairs Minister shortly and we know about it but who will be choose to assume the post is vague or unclear to us and it is the competence of PM Gusmao to make nomination,” da Costa said.

MP da Costa added that Timor-Leste was a young country and therefore it needed time to better develop the country. Meanwhile, the Acting State Secretary for Council of Ministers Avellino Coelho said that the Council of Ministers had never discus about nomination of deputy for Foreign Affairs Minister.

State Secretary Coelho also refused to made the comment on the official letter sent by Prime Minister Xanana Gusmao to the Parliament as it was the competence of PM to did so.

WOODSIDE CHANGES SUNRISE GAS POSITION : E.TIMOR

DILI — Australia's Woodside Petroleum has promised East Timor it will re-examine Dili's demands for gas from the Greater Sunrise field to be processed on East Timorese soil, an official said Wednesday.

East Timor official Fransisco Monteiro said the company, a major partner in the Greater Sunrise consortium, had backed away from its position that an offshore floating platform was the most economically viable option.

Monteiro has been holding talks with Australian government officials and Woodside in Dili over the past two days in a bid to break the impasse over East Timor's insistence the gas be piped to East Timor for processing.

"Today was very impressive because Woodside came with three options. They used to only have one option and that was only to process the gas on a floating platform," he told AFP.

"Now they also offered options of a pipeline coming into East Timor or a pipeline coming into Darwin" in northern Australia.

Monteiro said further talks would be required but warned that Dili would "use any means" to ensure the gas from the gas field -- split 50-50 between East Timor and Australia -- would be processed in East Timor.

"This is one step ahead, which is good and positive. And we can be a little happy because our strategy has been well executed and they have changed their position. Hard work, however, is still needed to achieve our target," he said.

Woodside officials were not available to comment after the meeting.

About 400 protesters shouted anti-Australian slogans Tuesday as officials from Canberra arrived at the first day of the talks with their East Timorese counterparts over the troubled project.

The student protesters shouted "Australia is a thief" and "Down with Australia", and carried banners condemning Woodside for treating the East Timorese as "fools" and trying to "steal" the tiny country's resources.

East Timor, which agreed to split projected multi-billion dollar revenues 50-50 with Australia after a maritime border dispute, has said a floating platform is untested and carries an unacceptably high level of uncertainty.

The joint venture however says it has studied all three options and the floating platform is the most economically viable.

The Sunrise Joint Venture comprises Woodside (33.4 percent), ConocoPhillips (30 percent), Shell (26.6 percent) and Osaka Gas (10 percent).

FERNANDA BORGES " CAVR TEM DE ESTAR SOB A TUTELA DO GOVERNO"

O Parlamento Nacional aprovou nesta Quarta Feira, duas leis para ajudar as vítimas do ano 1975-1999. Estas propostas dão importância ao relatório de Comissão Amizade Verdade e Reconciliação (CAVR).

A Presidente da Comissão A do Parlamento Nacional, Fernanda Borges, explicou que "o PN não é representante do partido mas sim como representante do povo de cada partido, por isso tem o dever de ser indenpendente para com todas as instituições dentro do país. “

"Têm que ser independentes de todas as instituições, nomeadamente com as leis que foram feitas por nós, como por ex. lei de CAVR, do intreresse Nacional”, continua Borges no Parlamento Nacional.

Fernanda Borges também questionou a existencia da instituição CAVR porque ainda não sabe se a CAVR é uma instituição autónoma ou se está inserida no Ministério Solidaridade Social.

Entretanto o Governo entregou a proposta ao MSS mas o mesmo rejeitou devido a outros assuntos prioritários tais como a dos veteranos e idosos. “Da minha parte esta instituição é muito importante por isso temos que colocar como uma instituição autónoma", sublinhou.

O deputado Domingos Sarmento, do partido da oposição FRETILIN, é da mesma opinião.

“A instituição tem que estar com o governo porque é ele quem implementa os planos, programas, e não o Parlamento” afirmou Domingos Sarmento. (Domingos da Silva/CJITL)
