SUSPENSION FOR THE GOVT OFFICIAL IS THE COMPETENCE OF THE PARLIAMENT

The Parliamentary President Fernando “Lasama” de Araujo recently said that it was the competence of the Prime Minister Xanana Gusmao to suspend the Government officials who engage in crime but actually it was the competence of the Parliament to do so as it was guaranteeing by the constitution article 133.

“Actually it is our false, because it is not the competence of the Prime Minister to suspend the Government’s officials but it is guaranteeing in the RDTL constitution that the Parliament has power to suspend the Government’s officials,” Lasama said.

The content of the RDTL Constitution Article 113 stated that “It is possible to sentence a Government official more than two years if she/he is found to engage in crime and she/he should quit its post in order to collaborate with the legal process.”
