Regarding the judiciary system and the practice of annual clemency in East Timor, which is exercised by the President of the Republic through his constitutional powers, the President of the Court of Appeal, Claudio Ximenes, called for the revision of the Constitution.
This call was made at a seminar at the Tourism Hotel, on June 29, through the Program for Monitoring the Judicial System under the topic, "Practice of the pardon, according to the political , judicial and civil society perspective under the rule of law.”
"Through the amnesty the President of the Republic can pardon people who have been convicted, but the head of the state also takes into account a list of people made by the Government, who have already been tried and are serving a sentence," said Claudio.
"We will have to revise the Constitution soon , as a way to limit the amnesty powers of the President," said Claudio.
Moreover, the Justice Minister, Lucia Lobato, said that the President is empowered to grant amnesty or commute the sentence of persons who were convicted, according to the article 85º paragraph a) of the RDTL Constitution.
For this reason, the National Parliamentary Commission C President ,Fernanda Borges ,asked to be created promptly a law to limit the powers of the President. (Callisto and Rubina / CJITL).
